Agreement to these terms
These Terms of Service (the "Terms") are a binding agreement between you and Blyx ("Blyx", "we", "us", "our"), the operator of blyx.dev and its related services (the "Service"). By creating an account, clicking "accept", or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
We welcome young founders. If you are under 18, you may use Blyx only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service and for any billing. Blyx is not directed to children under 13, and anyone under 13 may use it only through, and under the supervision of, a parent or guardian who operates the account. If you use the Service for an organization, you represent that you are authorized to bind it, and "you" includes that organization.
What Blyx is
Blyx is an AI-powered tool that helps you generate, edit, host, publish, and market websites and related business assets. Blyx is a neutral instrument: you decide what to create, what to publish, and how to use it. We do not pre-screen, endorse, or take ownership of what you make.
Features, limits, and availability depend on your plan and may change, be added, or be removed over time. We may set or adjust technical and usage limits to protect the Service.
Your account
You are responsible for your account, your login credentials, and all activity that occurs under your account, whether or not you authorized it. Keep your credentials secure and provide accurate information. Notify us promptly at support@blyx.dev of any unauthorized use. One person or entity per account unless we agree otherwise.
Plans, credits & billing
- Builds, edits, and certain features consume credits. Paid plans are subscriptions that renew automatically until cancelled. You may cancel anytime and keep access through the end of the current billing period.
- Payments are processed by Stripe ; by paying you also agree to Stripe's terms. We never store your full card number.
- Except where required by law, fees and used credits are non-refundable, and unused subscription benefits do not carry over except as expressly stated on your plan.
- Prices, plan features, and credit costs may change. Changes apply to future billing periods, and continued use after a change means you accept it.
- You are responsible for any taxes other than taxes on our net income.
Your content & ownership
You own the websites and content you create with Blyx ("Your Content"), and you are solely responsible for them. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process Your Content only as needed to operate and provide the Service to you (including hosting your published sites and passing prompts to our AI providers).
You represent and warrant that you own or have all necessary rights to Your Content and everything you upload or publish, and that Your Content does not infringe, violate, or misappropriate anyone's rights or any law.
AI-generated output
Blyx uses artificial intelligence to generate output. AI output may be inaccurate, incomplete, or similar to output generated for others, and is not guaranteed to be original, unique, non-infringing, or fit for any purpose. We make no warranty that output is free of third-party rights.
You are solely responsible for reviewing, editing, testing, and ensuring that anything you publish is accurate, lawful, and compliant with every law and regulation that applies to you and your visitors — including privacy, accessibility, advertising, consumer-protection, and industry-specific rules.
Acceptable Use Policy
You may not use Blyx — and may not create, publish, distribute, or drive traffic to anything with Blyx — to do, promote, or facilitate any of the following. This list is not exhaustive; the spirit is: nothing illegal, harmful, deceptive, or that violates others' rights.
- Illegal content or activity of any kind, or content that facilitates it.
- Child sexual abuse material (CSAM) or any sexual content involving minors — zero tolerance; reported to authorities and NCMEC.
- Fraud, scams, phishing, deceptive or "get-rich-quick" schemes, fake stores, or impersonation of any person, brand, or entity.
- Malware, spyware, ransomware, credential harvesting, or code intended to disrupt, damage, or gain unauthorized access to any system.
- Infringement of copyright, trademark, patent, trade-secret, publicity, or privacy rights.
- Content that incites, threatens, or glorifies violence, terrorism, or that promotes hatred or harassment against people based on a protected characteristic.
- Unlawful sale or promotion of regulated goods (weapons, controlled substances, prescription drugs, gambling, etc.) without all required licenses and compliance.
- Spam, unlawful bulk messaging, or deceptive SEO/traffic manipulation.
- Sexually explicit material where prohibited, or content harmful to minors.
- Attempts to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service, or to resell or white-label the Service without our written permission.
- Any use that violates sanctions or export-control laws (see the Export & sanctions section below).
You alone are responsible for everything you create and publish. Blyx does not endorse and is not responsible for user content. We may (but are not obligated to) refuse, remove, disable, or limit any content or account at any time, with or without notice, that we believe in our sole discretion violates these Terms or the law, or that exposes Blyx or others to liability.
Reporting abuse, moderation & law enforcement
We want Blyx used for good. To report content that is illegal or violates these Terms, email legal@blyx.dev with the URL and details. We review reports in good faith and act on them.
While we have no obligation to monitor user content, we reserve the right to review it and to remove or disable anything we believe is unlawful or violates these Terms. We cooperate with valid legal process and law-enforcement requests, and we may preserve and disclose content and account information where we believe in good faith it is required by law, necessary to enforce these Terms, or necessary to protect the rights, safety, or property of Blyx, our users, or the public. Our good-faith moderation and cooperation do not make Blyx the author, publisher, or endorser of user content.
For governments & law enforcement
This section is addressed directly to government agencies and law-enforcement authorities. Blyx is a responsible platform and is committed to keeping illegal content off the internet. We are a neutral hosting and creation tool — we do not author user sites — but we do not want our Service used for harm, and we act when it is.
What we remove and act on. We promptly disable, remove, and where appropriate report sites and accounts that are illegal under applicable law, including: terrorism and violent extremism; child sexual abuse material (CSAM — zero tolerance, reported to NCMEC and authorities); credible threats or incitement of violence; fraud and financial crime; malware and attacks on other systems; and other serious criminal activity. We do not need a court order to remove content that plainly violates our Acceptable Use Policy or the law.
How to submit a request. Authorities may send lawful requests (subpoenas, court orders, warrants, preservation requests, or other valid legal process) to legal@blyx.dev. Please identify the specific URL(s) or account, the unlawful content or conduct at issue, the legal basis, and the requesting authority and jurisdiction. We review every request in good faith and respond as required by applicable law.
Emergencies. For situations involving an imminent risk of death or serious physical harm (including terrorism or a child in danger), email legal@blyx.dev with "EMERGENCY" in the subject line and we will review on an expedited basis.
What we ask in return. Consistent with the rule of law, we ask that requests have a valid legal basis and be appropriately scoped. We comply with applicable law and valid legal process; we are not able to remove content that is lawful merely on the basis of an informal or improperly-founded demand, and where legally permitted we may notify affected users. This protects lawful expression while ensuring genuinely illegal content is dealt with decisively. Nothing in this section waives any right or defense of Blyx or its users.
Copyright & DMCA
We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws. If you believe content on Blyx infringes your copyright, send a notice to our designated agent at legal@blyx.dev including: your contact information; identification of the work; the infringing URL; a statement of good-faith belief; a statement under penalty of perjury that the notice is accurate and you are authorized to act; and your physical or electronic signature.
We remove infringing content on valid notice, forward notices where appropriate, honor counter-notices, and terminate repeat infringers.
Your responsibility & indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Blyx and its owners, employees, and agents from and against any claims, damages, losses, liabilities, fines, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms or any law; or (d) your violation of any third party's rights. This obligation survives termination.
Disclaimers
The Service and all output are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that output will be accurate, original, or lawful for your use. Blyx is not responsible for user content or for anything you or others create, publish, or do with the Service.
Limitation of liability
To the fullest extent permitted by law, Blyx will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business, arising out of or related to the Service — even if advised of the possibility. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; in that case our liability is limited to the smallest amount permitted by law.
Third-party services
Blyx relies on third-party providers, including Supabase (database & auth), Stripe (payments), Anthropic (AI), Vercel (hosting), and others. Your use of features relying on them is also subject to their terms, and we are not responsible for third-party services. Domains you connect or register are subject to the registrar's and registry's terms.
Export, sanctions & compliance
You represent that you are not located in, and will not use the Service in or for the benefit of, any country or party subject to U.S. or other applicable sanctions or embargoes, and that you are not on any restricted-party list. You agree to comply with all applicable export-control and sanctions laws.
Our intellectual property
Blyx, its name, logo, owl, software, templates, and design system are owned by us and protected by law. These Terms grant you no rights to our brand except the "Made with Blyx" attribution where it applies. You may not remove, obscure, or falsify any attribution the Service adds unless your plan permits it.
Suspension & termination
You may stop using Blyx and delete your account at any time. We may suspend or terminate your account or any content immediately, with or without notice, if we believe you have violated these Terms or the law, or to protect the Service, other users, or third parties. On termination your right to use the Service ends; sections that by their nature should survive (ownership, disclaimers, liability limits, indemnity, dispute resolution) survive.
Governing law & dispute resolution
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at legal@blyx.dev and attempt to resolve the dispute informally for at least 30 days.
Any dispute not resolved informally will be settled by binding individual arbitration (not in court and not before a jury), except that either party may bring qualifying claims in small-claims court, and either party may seek injunctive relief for intellectual-property or unauthorized-access matters. You and Blyx waive any right to a jury trial and to participate in a class action or class-wide arbitration — claims may be brought only in an individual capacity. If this class-action waiver is found unenforceable, the arbitration provision is void for that dispute.
Changes to these terms
We may update these Terms; the "last updated" date shows the latest version, and material changes may be signaled in-app or by email. Continued use after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service.
